Important 2026 Update
The Code on Social Security, 2020 came into force on 21 November 2025, replacing the earlier Payment of Gratuity Act, 1972 framework for current gratuity entitlements. Revised wage rules and specific eligibility exceptions may affect the final amount.
This guide explains the standard calculation and the situations where individual assessment may be necessary.
What Is Gratuity?
Gratuity is a lump-sum employment benefit payable by an eligible employer to an employee when the applicable conditions are fulfilled. It recognises qualifying service and is commonly paid when employment ends through retirement, resignation or other specified events.
For gratuity payable under the current statutory framework, the principal legal reference is Chapter V of the Code on Social Security, 2020. The amount generally depends on applicable last-drawn wages and qualifying continuous service.
Gratuity is different from regular salary, annual performance bonuses and provident fund balances. It should be evaluated separately when planning retirement benefits or a change in employment.
Who Is Eligible for Gratuity?
For regular employees in covered establishments, gratuity generally becomes payable after five years of continuous service when employment ends in a qualifying manner. However, the law provides important exceptions.
- Regular employees: Generally require five years of continuous service with the relevant employer, subject to statutory conditions.
- Death or disablement: The usual five-year condition is waived in qualifying cases.
- Eligible fixed-term employees: Gratuity may become payable after one year of service under the applicable fixed-term employment rules.
- Covered establishments: Statutory coverage depends on the type and size of establishment and the relevant legal provisions.
- Special employment categories: Some workers and employment arrangements have separate qualifying-service or computation provisions.
Does Everyone Need to Complete Five Years?
No. The five-year rule is a general requirement, not an absolute rule for every employee. Death, disablement and qualifying fixed-term employment can have different treatment.
ध्यान दें: हर employee के लिए पाँच साल की service अनिवार्य नहीं है। Eligibility employment category और applicable rules पर निर्भर करती है।
How to Use the Gratuity Calculator
For a standard estimate, you need three basic inputs. Use accurate employment records rather than approximating dates or wage amounts.
Enter Eligible Monthly Wages
Enter the last-drawn monthly wage amount used for gratuity computation. The revised statutory definition may require consideration of wage components and the applicable allowance add-back rule.
Select Your Joining Date
Provide the actual date on which qualifying employment began. Continuous service is important when determining gratuity entitlement.
Select Your Leaving Date
Enter your actual or proposed employment end date. The calculator uses the service period to estimate the amount for a standard eligible employee.
How Accurate Is the Calculator?
It provides an estimate based on the inputs and formula used. A statutory entitlement may require adjustments for fixed-term employment, death, disablement, special service provisions, wage components and other applicable conditions.
The actual amount payable should be confirmed using the employer's records and current legal provisions.
Gratuity Formula and Calculation
For a standard monthly-rated employee covered by the statutory gratuity provisions, the calculation generally uses fifteen days of applicable wages for every completed year of service or qualifying part of a year exceeding six months.
Days of Wages
Fifteen days of wages per qualifying year in the standard statutory method.
Monthly Divisor
Divisor used for the standard monthly-rated gratuity calculation.
Qualifying Service
Completed years plus any additional period that qualifies under the applicable rounding rule.
Gratuity Calculation Example
Suppose an employee has ₹40,000 in last-drawn eligible monthly wages and completes 10 years and 7 months of qualifying service.
Under the standard formula, the service period is counted as 11 years because the additional period exceeds six months.
The estimated gratuity is approximately ₹2,53,846, before considering any applicable statutory ceiling or special circumstances.
Note the distinction: an extra period of more than six months is counted under the standard statutory rounding rule. Do not assume that exactly six months must always be rounded up.
What Counts as Last-Drawn Wages in 2026?
The Code on Social Security, 2020 uses a statutory definition of wages that generally includes specified components such as basic pay and dearness allowance, along with applicable adjustments for excluded allowances crossing the prescribed limit.
Therefore, the entire CTC should not automatically be entered as wages. Equally, Basic + DA alone may not capture every statutory wage adjustment.
Is Gratuity Taxable in India?
The tax treatment of gratuity depends on the employee's category, the nature of the payment and the applicable tax-year provisions. The taxable amount may differ from the gross gratuity received.
| Employee Category | General Tax Treatment |
|---|---|
| Eligible Government Employees | Qualifying death-cum-retirement gratuity under specified government service provisions is fully exempt. |
| Other Employees Covered by Statutory Gratuity Provisions | Exemption is generally restricted to the least of actual gratuity, the relevant statutory computation and the applicable notified tax-exemption limit. |
| Employees Outside the Applicable Statutory Gratuity Computation | Separate exemption computation rules apply, including relevant average-salary and completed-service conditions. |
| Gratuity Paid During Continuing Employment | Such payments may have different tax treatment from qualifying retirement or termination gratuity. |
Gratuity Tax Exemption: What About ₹20 Lakh?
₹20 lakh is an important notified exemption ceiling for relevant non-government employee categories. It is not a promise that every gratuity payment up to ₹20 lakh is tax-free. The other applicable exemption conditions must also be met.
For tax years governed by the Income-tax Act, 2025, gratuity-related salary deductions are addressed under Section 19. For earlier years governed by the Income-tax Act, 1961, the familiar reference is Section 10(10).

Gratuity for Government vs Private Employees
Government and private-sector employees can be subject to different service rules and tax-exemption provisions. It is important to distinguish gratuity entitlement from the income-tax treatment of the amount received.
| Feature | Government Employees | Private-Sector Employees |
|---|---|---|
| Governing Framework | Applicable government service and pension rules. | Code on Social Security, 2020, where applicable, and relevant employment terms. |
| Calculation | Based on applicable service rules and prescribed pay components. | Generally based on statutory eligible wages, qualifying service and relevant gratuity formula. |
| Eligibility | Depends on applicable service conditions. | Generally five years for regular covered employees, subject to exceptions. |
| Tax Treatment | Qualifying gratuity under specified government rules may be fully exempt. | Exemption is subject to the applicable salary, service and notified-limit conditions. |

Gratuity Calculator FAQs
How is gratuity calculated?
For a standard eligible monthly-rated employee, the formula is eligible last-drawn wages × 15 × qualifying years ÷ 26. The final amount may depend on statutory wage adjustments, service conditions and applicable limits.
Is five years of service compulsory for gratuity?
Generally, five years of continuous service is required for regular employees covered by the relevant provisions. However, exceptions apply for death, disablement and eligible fixed-term employment.
Can a fixed-term employee receive gratuity after one year?
Yes. Under the current social security framework, eligible directly engaged fixed-term employees may qualify after completing one year of service under the relevant contract. The exact employment arrangement matters.
Is gratuity taxable?
It may be fully exempt, partly exempt or taxable depending on the employee category and applicable exemption provisions. A ₹20 lakh ceiling applies to specified categories, but does not make every payment automatically exempt.
Does four years and ten months count as five years?
Do not treat four years and ten months as an automatically established five-year entitlement. Continuous-service rules and relevant judicial interpretations can affect particular cases. Confirm the applicable position for the employment circumstances.
How are additional months counted?
Under the standard statutory calculation, an additional period exceeding six months is counted as another year. The qualifying-service rule must be applied to the relevant employee category.
Is ₹20 lakh the maximum gratuity an employer can pay?
Not necessarily. The statutory payable amount and the income-tax exemption limit are separate concepts. More favourable employment terms may provide a higher payment, subject to applicable law. The excess may be taxable.
Can I receive gratuity after resignation?
Yes, resignation can be a qualifying event when the applicable service and eligibility conditions are met. Other legal conditions, including specified forfeiture provisions, may apply.
Should I enter Basic salary or full CTC?
Do not automatically enter full CTC. Use wages calculated according to the applicable statutory definition, which may include basic pay, dearness allowance and relevant adjustments under the allowance rule.
Is the gratuity calculator estimate final?
No. A calculator provides an estimate. The final gratuity payable depends on actual service, eligible wages, applicable law and employer records. Special employment cases may require a separate calculation.
