Is Pension Income Taxable in India?
Yes, pension income can be taxable, but the treatment depends on whether it is a regular pension, family pension or commuted pension. Different income heads, deductions and exemptions apply.
Regular or Uncommuted Pension
A regular pension received by a retired employee from a former employer is generally taxable under the head Income from Salaries.
- Generally included in salary income for ITR purposes.
- Eligible pensioners may claim the applicable salary standard deduction.
- Tax liability depends on pension, other income, chosen tax regime and applicable reliefs.
Family Pension
Family pension received by a spouse or other eligible family member after the employee's death is generally reported under Income from Other Sources.
- Normally not treated as the recipient's own salary income.
- Under the general deduction rules, one-third of qualifying family pension is deductible, subject to a ceiling: ₹25,000 in the new regime or ₹15,000 in the old regime.
- Special exemptions may apply to certain qualifying family pensions.
Commuted Pension
Commuted pension is a lump-sum amount received in exchange for surrendering a portion of periodic pension. It may be fully or partly exempt, depending on the employment category.
- Qualifying commuted pension received by eligible government employees is fully exempt.
- For non-government employees receiving gratuity, exemption is generally based on one-third of the full commuted value.
- For non-government employees not receiving gratuity, the corresponding fraction is generally one-half.
Why Identifying the Pension Type Matters
Regular pension, family pension and commuted pension do not follow identical tax rules. The relevant tax year, pension source and exemptions must be considered before selecting the income head in your ITR.
Example: A spouse receiving family pension generally cannot claim the regular salary standard deduction against that family pension. The separate family pension deduction rules apply instead.
Retirement Tax Planning Beyond Pension Income
Retirement finances can include pension, gratuity, bank interest, fixed deposits and investments. Understanding these sources separately helps you estimate taxable income and make informed financial plans.
Estimate Your Gratuity Benefit
If you expect a gratuity payment on retirement, you can calculate gratuity at retirement using your eligible wages and qualifying service. Tax treatment is separate from the gratuity calculation.
Estimate Your Retirement Corpus
Use the retirement planning calculator to estimate future expenses, target savings and retirement-fund requirements.
Review Fixed Deposit Income
If fixed deposits form part of your retirement savings, the FD calculator can estimate interest and maturity amounts. Tax and TDS are determined separately.
Plan Investment Withdrawals
Use the SWP calculator to estimate how systematic withdrawals may affect an investment corpus. Returns are not guaranteed.
Understand TDS Declarations
For Tax Year 2026–27 onward, eligible taxpayers can review Form 121 for non-deduction of TDS . It replaces the older Forms 15G and 15H. Conditions apply before a declaration can be made.
Need Help Filing ITR on Pension and Interest Income?
Easy Return can assist with pension income, family pension, bank interest, applicable deductions, AIS and TDS/TCS review while preparing your return.
TDS Deducted on Your Pension or Bank Interest?
TDS deducted from pension or bank-interest income may be refundable if your total eligible tax credits exceed your final income-tax liability. Check the tax records and file the appropriate ITR to claim any eligible refund.
Pension or Interest Income
You receive pension income, fixed-deposit interest or other taxable receipts.
TDS May Be Deducted
The pension-paying institution or bank may deduct tax under applicable rules.
Tax Credits Checked
Review the relevant TDS certificates, Form 26AS, AIS and available tax-credit records.
ITR Filed & Verified
Report income, claim eligible tax credits and complete ITR e-verification.
Eligible Refund Processed
The department checks the return and processes any refund found due.
Pension TDS Review
Pension TDS records should be compared with actual pension income and applicable certificates. For FY 2025–26, the relevant salary certificate may be Form 16 ( Now Form 130 ) under the newer 2026 framework.
Bank Interest & FD TDS
Interest income should be reported correctly even when TDS has already been deducted. Compare bank statements and certificates with Form 26AS, AIS and applicable tax-credit information.
When Can a Pensioner Receive a TDS Refund?
An income-tax refund may arise when TDS/TCS, advance tax and other eligible tax payments exceed the taxpayer's final tax liability after applicable deductions, exemptions, rebates and relief.
Example: If total eligible tax credits are ₹18,000 and final tax liability is ₹10,000, the calculated excess is ₹8,000. This may be claimed as a refund through an eligible income tax return, subject to processing and any applicable adjustments.
ध्यान दें: TDS कटने का मतलब यह नहीं कि refund हमेशा मिलेगा। Refund आपकी final tax liability और available tax credits पर निर्भर करता है।
Tax Benefits We Check Before Filing Your ITR
We review pension income, interest earned on deposits and applicable medical deductions. The benefits available to a pensioner depend on the tax year, age, residency and tax regime.
Standard Deduction on Pension
Regular pension received from a former employer is generally taxed under the salary head. Eligible pensioners can claim the applicable salary standard deduction.
This does not automatically apply to family pension, which has separate rules.
Deduction on Bank Deposit Interest
Under Section 80TTB (Now Section 153), an eligible resident senior citizen may claim a deduction for qualifying interest on deposits with banks, specified cooperative banking institutions and post offices.
The deduction is relevant under the old tax regime and is limited to the qualifying interest actually earned, up to the prescribed ceiling.
Health Insurance & Medical Expenses
Under the old tax regime, Section 80D can provide deductions for eligible health insurance premiums and certain medical expenditure relating to senior citizens.
The rules differ depending on whether the expenditure relates to the taxpayer, spouse or parents. Medical expenditure has specific conditions, including where no health insurance policy covers the senior citizen.
Specified Disease Treatment Deduction
Section 80DDB provides a deduction under the old tax regime for eligible expenditure on treatment of prescribed diseases or ailments.
For eligible senior citizen treatment expenses, the limit can reach ₹1 lakh. Actual deduction depends on qualifying expenditure, required medical evidence and adjustments for relevant reimbursements.
Which Tax Benefits Apply Under the Old and New Regimes?
| Benefit | Old Tax Regime | New Tax Regime |
|---|---|---|
| Standard Deduction on Eligible Regular Pension | Up to ₹50,000. | Up to ₹75,000. |
| Bank Interest — Section 80TTB | Up to ₹50,000 for eligible resident seniors. | Generally not available. |
| Health Insurance — Section 80D | Eligible deductions subject to limits. | Generally not available. |
| Specified Disease — Section 80DDB | Eligible deductions subject to limits and documentation. | Generally not available. |
What We Review for Senior Citizen ITR Filing
Review Your NPS Retirement Projections
If you have investments under the National Pension System, you can estimate your NPS pension and assess how contribution amounts, investment periods and assumed returns may affect your projected retirement corpus. NPS returns are market-linked and not guaranteed.
Important: Senior Citizen Deductions Depend on Your Tax Regime
Section 80TTB, Section 80D and Section 80DDB deductions should not be automatically applied to a pensioner under the new tax regime. The total tax payable must be calculated using the correct tax year, regime and eligibility.
For FY 2025–26 / AY 2026–27: The Income-tax Act, 1961 provisions govern the return. For income earned from 1 April 2026 onward, relevant provisions of the Income-tax Act, 2025 must be considered.
ध्यान दें: Senior citizen होने का मतलब यह नहीं कि हर deduction दोनों tax regimes में मिलेगी। ITR file करने से पहले सही regime और eligibility जरूर check करें।
Which ITR Form Should a Pensioner File?
The appropriate income tax return depends on your pension, bank interest, capital gains, property income and any business or professional income. Age alone does not determine your ITR form.
Simple Pension & Interest
Check ITR-1 eligibility.
More Complex Non-Business Income
ITR-2 may be appropriate.
Business or Professional Income
Assess ITR-3 or eligible ITR-4.
ITR-1 (Sahaj) for Pensioners
ITR-1 may be suitable for a resident individual (other than RNOR) with total income up to ₹50 lakh, provided the income sources and other conditions are permitted under the form.
- Regular pension or salary income.
- Eligible bank and deposit interest.
- Family pension under permitted other sources.
- Eligible house-property income.
- Section 112A long-term capital gains up to ₹1.25 lakh for AY 2026–27, subject to form conditions.
ITR-2 for Pensioners
ITR-2 is generally relevant for individuals who are not eligible for ITR-1 and do not have income chargeable under profits and gains of business or profession.
- Short-term capital gains or capital gains beyond ITR-1 permissions.
- Foreign assets or foreign income requiring reporting.
- Non-resident or RNOR status, where applicable.
- Multiple house properties beyond ITR-1 eligibility.
- Other prescribed situations that exclude ITR-1.
ITR-3 or ITR-4 for Pensioners
A pensioner who also earns income from business or profession may need ITR-3. ITR-4 (Sugam) can be considered where the taxpayer qualifies for presumptive taxation and satisfies all form eligibility requirements.
- Business or professional income.
- Eligible presumptive income under Sections 44AD, 44ADA or 44AE for AY 2026–27.
- ITR-4 total-income limit of ₹50 lakh and applicable residential-status conditions.
- Other permitted income, assets and disclosures must meet form restrictions.
Quick Comparison: Pension Income and ITR Forms
| Income Situation | Form to Check |
|---|---|
| Pension + eligible bank interest + simple income | ITR-1 |
| Pension + Section 112A LTCG up to ₹1.25 lakh, with all other ITR-1 conditions met | ITR-1 may apply |
| Pension + short-term capital gains or foreign asset disclosures, without business income | ITR-2 |
| Pension + regular business or professional income | ITR-3 |
| Pension + eligible presumptive business or professional income | ITR-4, if eligible |
Important: ITR Form Selection Has Additional Conditions
Having pension income does not automatically mean you can file ITR-1. Residential status, total income, capital gains, property holdings, foreign assets, business income and other statutory exclusions can affect the correct form.
Tax-year distinction: Income earned in FY 2025–26 is filed for AY 2026–27 under the Income-tax Act, 1961. For Tax Year 2026–27 under the Income-tax Act, 2025, use the return form and eligibility rules applicable to that year when notified.
ध्यान दें: केवल pension income देखकर ITR form select न करें। आपकी दूसरी income और reporting requirements भी check करना जरूरी है।

Do You Need to Upload All These Documents With Your ITR?
No. Income Tax Returns are generally annexure-less, meaning supporting documents are not ordinarily attached when submitting the return. However, the information must be reported accurately and relevant records should be retained.
If your ITR includes capital gains, rental income, foreign assets or other additional income sources, further records may be required to prepare the return correctly.
ध्यान दें: हर pensioner के लिए सभी documents जरूरी नहीं हैं। आपकी income और tax deductions के अनुसार documents अलग हो सकते हैं।

Old vs New Tax Regime for Pensioners
Both tax regimes can apply to eligible pensioners, but they differ in tax slabs, deductions and exemptions. Your pension income, bank interest, medical expenses and other taxable income should be considered before choosing a regime.
Old Tax Regime
The old tax regime allows eligible taxpayers to claim specified deductions and exemptions, subject to the relevant conditions. This can reduce taxable income, although the applicable slab structure differs from the new regime.
- Regular pension: Eligible salary standard deduction up to ₹50,000.
- Section 80TTB: Eligible resident senior citizens can deduct qualifying deposit interest, subject to a ₹50,000 ceiling.
- Section 80D: Eligible health insurance premiums and qualifying medical expenditure may be deductible.
- Section 80DDB: Eligible treatment expenses for specified diseases may qualify for deduction.
- Family pension: General deduction of one-third of qualifying family pension, subject to a ₹15,000 ceiling.
May be beneficial when: Your eligible deductions and exemptions produce a lower final tax liability than the new regime.
New Tax Regime
The new tax regime under Section 115BAC(1A) (Now Section 202) offers revised income-tax slabs and permits specified deductions, while restricting several deductions available under the old regime.
- Regular pension: Eligible salary standard deduction up to ₹75,000.
- New tax slabs: Ordinary taxable income up to ₹4 lakh falls in the nil-rate band for AY 2026–27.
- Section 87A rebate: For AY 2026–27, eligible resident individuals with qualifying total income up to ₹12 lakh may receive a rebate up to ₹60,000 against normal-rate tax.
- Family pension: General deduction of one-third of qualifying family pension, subject to a ₹25,000 ceiling.
- Restricted deductions: Personal deductions under Sections 80TTB, 80D and 80DDB generally cannot be claimed under the new regime.
May be beneficial when: Revised slabs, applicable standard deduction and rebate result in lower tax than the old regime.
Which Tax Regime Should a Pensioner Choose?
There is no single best regime for every pensioner. The correct comparison requires calculating tax under both regimes using all relevant income and allowable deductions.
For example, a pensioner with significant qualifying deposit interest, medical expenses and other old-regime deductions may find the old regime useful. Another pensioner with fewer deductions may benefit from the new regime's slabs and rebate.
Special-rate income, residential status, total income and the relevant tax year may also affect the comparison.
What We Review Before Filing Your Pension ITR
Important Tax-Year Clarification
FY 2025–26 / AY 2026–27: The new tax regime is governed by Section 115BAC(1A) of the Income-tax Act, 1961.
Tax Year 2026–27 onward: Section 202 of the Income-tax Act, 2025 governs the new tax regime. Deductions and filing requirements must be checked for the specific tax year.
ध्यान दें: Pensioners के लिए old regime या new regime में कौन बेहतर है, यह आपकी total income और eligible deductions पर निर्भर करता है।
Frequently Asked Questions About Pensioner ITR Filing
Answers to common questions about pension taxation, senior citizen tax benefits, bank interest, ITR forms and TDS refunds in India.
01 Do pensioners need to file an Income Tax Return?
Pensioners may need to file an ITR if their income or circumstances meet the applicable filing requirements. Filing is not determined by age alone.
Even when tax has already been deducted, filing may be necessary or useful to report income, reconcile TDS/TCS credits and claim an eligible tax refund. Specific filing exemptions may apply in limited cases.
02 Is pension income taxable in India?
Regular or uncommuted pension received from a former employer is generally taxable under Income from Salaries.
Family pension is generally taxable under Income from Other Sources. Qualifying commuted pension may be fully or partly exempt depending on the employee category and applicable conditions.
03 Which ITR form should a pensioner file?
ITR-1 may be appropriate for an eligible resident individual with simple pension income, qualifying other income and total income within the applicable ₹50 lakh limit.
ITR-2 may apply when more complex non-business income or disclosures are involved. Business or professional income generally requires consideration of ITR-3 or eligible ITR-4.
For AY 2026–27, certain Section 112A long-term capital gains up to ₹1.25 lakh may be reported in ITR-1 if all other conditions are satisfied.
04 Can a pensioner claim a TDS refund?
Yes, if eligible. A refund may arise when total eligible TDS/TCS and other tax payments exceed the final tax liability for the year.
Report the income correctly, reconcile the available tax credits with Form 26AS and AIS, and file and verify the applicable ITR. The refund is subject to department processing.
05 Is FD and bank interest taxable for senior citizens?
Bank deposit and fixed deposit interest are generally included in taxable income, even when the bank has already deducted TDS.
Eligible resident senior citizens may claim a deduction on qualifying deposit interest under Section 80TTB (Now Section 153), generally under the old tax regime.
06 What is Section 80TTB for senior citizens?
Section 80TTB (Now Section 153) provides an eligible resident senior citizen with a deduction of up to ₹50,000 on qualifying deposit interest from specified banking and post-office institutions.
The deduction is subject to the actual qualifying income and applicable tax-regime conditions. It is not generally available in the new tax regime.
07 Do senior citizens have to pay advance tax?
Under Section 207(2) of the Income-tax Act, 1961, a resident individual aged 60 or above during the relevant previous year who has no income chargeable under profits and gains of business or profession is generally not required to pay advance tax.
This does not automatically exempt the person from final income-tax liability or ITR filing requirements.
08 Do senior citizens aged 75 or above need to file ITR?
Not everyone aged 75 or above is exempt. For FY 2025–26, Section 194P provides a filing exemption to qualifying resident senior citizens meeting specific conditions.
The person must generally have pension income and only permitted interest income from the same specified bank, furnish the prescribed declaration, and have tax computed and deducted by that bank.
For Tax Year 2026–27 under the Income-tax Act, 2025, the corresponding declaration is Form 125 (earlier Form 12BBA).
09 Is family pension taxable?
Family pension is generally reported under the head Income from Other Sources, not as the recipient's regular salary.
A deduction of one-third of qualifying family pension may be available, subject to a ceiling of ₹15,000 under the old regime or ₹25,000 under the new regime for AY 2026–27. Certain special family pensions may qualify for separate exemptions.
