Don’t Have Form 16 / Form 130?

You can still file your ITR with salary slips, Form 26AS, AIS and basic details.

Missed the ITR Due Date?

What Happens If You File Your ITR Late?

Missing Form 16 or Form 130 should not make you delay your ITR unnecessarily. Late filing can lead to fees, interest and loss of some tax benefits.

i
For AY 2026-27 Belated ITR filing is still possible up to 31 December 2026

The return must be filed before the applicable belated-return deadline or before completion of assessment, whichever happens earlier.

01
Late Filing Fee

Fee Under Section 234F

If you were required to file an ITR but missed the applicable due date, a late-filing fee may apply.

Situation Late Filing Fee
ITR filed on or before the applicable due date No Late Fee
Total income does not exceed ₹5 lakh and return is filed late ₹1,000
Total income exceeds ₹5 lakh and return is filed late ₹5,000
You are not legally required to file an ITR Fee may not apply
02
Interest

Interest May Apply If Tax Is Still Unpaid

Late filing can also lead to interest when tax remains payable or advance tax requirements were not met.

234A

Late Filing With Tax Due

Interest is generally charged at 1% per month or part of a month on unpaid tax for delay in filing.

234B

Advance Tax Shortfall

Interest may apply where the required advance tax was not paid sufficiently during the year.

234C

Delay in Advance Tax Instalments

Interest may apply when required advance tax instalments were paid late or were short.

03
Other Impact

Late Filing Can Affect More Than the Filing Fee

Depending on your tax situation, filing after the due date can affect other benefits as well.

!
Carry Forward of Certain Losses

Certain business and capital losses generally need a return of loss filed within the due date to remain eligible for carry-forward.

₹
Extra Interest Cost

If tax is still payable, the longer the delay, the more interest may become payable.

⏱
Less Time to Fix Issues

Filing close to the final deadline leaves less time to correct missing records or other problems.

✓
Belated Return Can Still Be Useful

If you missed the normal due date, filing a valid belated return is generally better than leaving the return unfiled where filing is required.

!
Important Do not guess your income just to file before a deadline.

If Form 16 / Form 130 is missing, use available records such as salary slips, Form 26AS, AIS and bank statements to prepare the return with correct information.

i

AY 2026-27 continues to be governed by the Income-tax Act, 1961. For returns under the Income-tax Act, 2025 from Tax Year 2026-27 onward, the late-filing fee structure remains ₹1,000 where total income does not exceed ₹5 lakh and ₹5,000 in other applicable cases.

Special Situations

Filing ITR Without Form 16 in Different Situations

Missing Form 16 / Form 130 can happen for different reasons. The records you need may change depending on how you earned your income during the year.

01
Salaried Employee

Changed Jobs During the Year

If you worked for more than one employer, salary and TDS details from all employers should be considered while preparing your ITR.

1
Collect Salary Details From Every Employer

Use available salary slips, salary credit records and employer details from each job.

2
Check TDS From All Employers

Review Form 26AS and AIS to check TDS reported against your PAN by each employer.

3
Standard Deduction Is Not Per Employer

The standard deduction applies to your total eligible salary income, not separately for every employer. The applicable amount depends on the tax regime and assessment year.

4
Check for Any Tax Shortfall

If one employer did not consider salary earned from another employer, your total TDS may be lower than your final tax liability.

✓

No Form 16 from your previous employer? Salary slips, Form 26AS, AIS and bank salary credits can still help prepare your return.

02
Freelancer / Consultant

You May Not Receive Form 16 at All

Freelance or professional income is not salary. For non-salary payments where TDS is deducted, the relevant TDS certificate is generally Form 16A.

1
Check Form 16A, Form 26AS & AIS

These records can help verify payments and TDS reported by clients or other deductors.

2
Keep Invoices & Bank Records

Your invoices and bank receipts help calculate the professional or freelance income earned during the year.

3
Section 44ADA May Apply

Eligible specified professionals may use the presumptive taxation scheme under Section 44ADA, subject to the applicable conditions and limits.

4
ITR Form Depends on Your Case

ITR-4 may be used if you meet its eligibility conditions. In other professional-income cases, ITR-3 may be applicable.

i
Section 44ADA Receipt Limit

For eligible specified professions, the normal gross-receipt limit is ₹50 lakh. It can increase to ₹75 lakh where cash receipts do not exceed 5% of total gross receipts, subject to the other conditions of the scheme.

i
Your Filing Depends on Your Actual Income Form 16 / Form 130 is only one source of information.

The correct ITR form, deductions and tax calculation depend on your salary, professional income, other income, tax regime and records available for the year.

Before You File

Common ITR Filing Mistakes and the Correct Process

When you file ITR without Form 16 or Form 130, checking your salary, TDS, AIS and other income records carefully can help avoid common filing errors.

01
Avoid These Errors

Common Mistakes to Avoid

Small mistakes can lead to TDS mismatch, incorrect tax calculation or delay in processing.

Mistake What Can Go Wrong Better Approach
Not checking AIS You may miss income or transactions already reported to the Income Tax Department. Check AIS before filing
Claiming TDS without checking tax records A mismatch in TDS credit can create processing issues or a tax demand. Match TDS with Form 26AS
Missing bank interest Savings account or FD interest may already appear in AIS or other reported records. Check AIS + bank statements
Claiming standard deduction more than once Changing jobs does not mean you can claim a separate standard deduction for each employer. Apply it once to eligible salary
Skipping e-verification An uploaded return that is not properly verified can become invalid. E-verify within 30 days
Ignoring tax payable If tax is still due, the return may show outstanding tax or additional interest. Pay self-assessment tax if required
Waiting until the last moment You may have less time to fix missing TDS, salary details or other filing issues. File before the applicable due date

Questions? Answered.

Frequently Asked Questions About Filing Without Form 16

Simple answers for salaried taxpayers who want to file ITR but do not have Form 16 / Form 130.

01 Can I file ITR without Form 16 / Form 130?

Yes. If Form 16 / Form 130 is not available, your return can still be prepared using other salary and tax records.

Salary slips, Form 26AS, AIS, bank salary credits and other income documents can help rebuild the information needed for your ITR.

02 Can I file without Form 16 if my salary is above ₹10 lakh?

Yes. A higher salary does not automatically make Form 16 mandatory for preparing the return.

The important part is that your salary, TDS, deductions and other income are calculated correctly using reliable records.

03 My employer has not given me Form 16. What should I do?

First, ask your employer or payroll team for the applicable salary TDS certificate.

If TDS was deducted, the employer has obligations relating to issue of the TDS certificate. In the meantime, you can check Form 26AS, AIS, salary slips and bank records to collect your filing information.

If TDS was deducted but is missing from Form 26AS, contact the employer before claiming that credit.
04 Do I need to upload salary slips with my ITR?

Normally, supporting documents such as salary slips are not attached to the Income Tax Return when it is filed online.

However, keep your salary slips, bank statements, deduction proofs and other supporting records safely in case they are required later.

05 Can I claim HRA without Form 16?

If HRA exemption is available in your applicable tax situation, it can be calculated using your salary and rent details even when Form 16 is missing.

The HRA calculation generally considers the lowest eligible amount based on actual HRA received, salary-based limits and rent paid. Keep rent receipts and other supporting details ready.

06 What if AIS and Form 26AS show different information?

Form 26AS is important for checking TDS credit available against your PAN, while AIS contains a wider range of reported financial information.

Compare both with your salary slips, bank statements and other records. If AIS contains incorrect information, use the feedback option available in the AIS portal.

07 What is the late filing fee if I miss the ITR due date?

For AY 2026-27, a delayed filing fee under Section 234F may apply if you were required to file your return but missed the due date.

Total income up to ₹5 lakh Up to ₹1,000
Total income above ₹5 lakh ₹5,000

Interest or other consequences may also apply depending on unpaid tax and your filing situation.

08 I am a freelancer. Do I need advance tax?

Advance tax is generally required if your estimated tax payable for the year is ₹10,000 or more after considering available TDS.

Normal advance tax is paid through instalments during the year. Different payment rules can apply if you use an eligible presumptive taxation scheme.

09 I changed jobs and have Form 16 from only one employer. Can I file?

Yes. Income from all employers should be included in one return.

For the employer whose Form 16 is missing, use available salary slips, salary credits, Form 26AS, AIS and other reliable records to work out the correct salary and TDS details.

10 Is e-verification required after filing?

Yes. After filing your ITR, complete the required verification process within the applicable time limit.

For regular electronic filing, the current verification window is generally 30 days from filing. Aadhaar OTP is one of the available e-verification methods.

✓
Key Point Missing Form 16 / Form 130 does not automatically stop ITR filing.

The goal is to rebuild the correct salary, income and TDS information from reliable records before submitting your return.
